Mineral Land Tenure
Solid ownership of the Mineral Rights to a Property is
fundamental to the success of any mining venture. We have access to a network
of industry-recognized "Peritos Mineros" (Mining Experts/Surveyors) and Mining
Lawyers to help us acquire the mineral rights to a Property either by staking
or by negotiating with the owners.
Mexico's Mining Law is published on the Direccion General de
Minas (DGM) website (http://www.economia-dgm.gob.mx) under Legislación
Minera. Some important points regarding Mineral Tenure are:
- A claim is staked by building a post with minimum dimensions
of 60 cm * 60 cm * 1 meter high. The post must be located within 3 km of the
claim boundary, and may be inside or outside of the property. Alternatively,
the unpainted face of an existing post may be used for a new claim. The outline
of the property is defined in polar co-ordinates from the post location.
- Within 60 working days of filing the staking application, the
official survey or "Trabajos Periciales" must be filed with the DGM.
- Formal title is usually received within 6 months of filing the
Trabajos Periciales.
- Upon receipt of the formal title document, mining duties are
paid to the government every six months in advance, and are calculated based on
the surface area of the claim.
- There are minimum annual work requirements to keep the
properties in good standing. These requirements are published on the
DGM's Website under
Solicitudes, Promociones y Informes.
